ENTRY: To be eligible to enter the Promotion, entrants must purchase a brand new compressor driven fridge freezer from an Engel retail outlet within the PROMOTIONAL PERIOD. Entrants must then enter the Promotion by completing the registration process via the Engel website during the Entry Period (www.engelaustralia.com.au). No additional expense or payment is required by the entrant to enter the Promotion. After submitting the required information on the Engel online registration form, the Entrant will receive one (1) entry into the Promotion. Entry to the promotion is restricted to one entry per customer per eligible purchase. Duplicate or automated entries will be disqualified.

 

The customer must submit proof of purchase at the time of registration in the form of tax invoice/receipt provided to them from the Engel retailer at the time of purchase, or other proof of purchase as deemed suitable by the Promoter matching the details submitted at the time of entry, or alternatively retain their proof of purchase for verification at the time of winner notification. Each winner is required to supply proof of purchase, matching the details submitted at the time of entry, to the Promoter before being awarded any Prize. Failure to supply proof of purchase within 90 days from notification will result in disqualification of entry.

 

WINNER SELECTION: All entries completed and submitted in accordance with these Terms and Conditions will be judged at the Engel Distribution SA Office, Unit 3, 18-20 Carsten Road, Gepps Cross SA 5094 on five (5) draw dates:

 

Draw 1: (For entries from 1 May 2016 until 31 May 2016) to be drawn Tuesday 7 June 2016 at 10am ACST

Draw 2: (For entries from 1 May 2016 until 30 June 2016) to be drawn Tuesday 5 July 2016 at 10am ACST

Draw 3: (for entries from 1 May 2016 until 31 July 2016) to be drawn Tuesday 9 August 2016 at 10am ACST

Draw 4: (for entries from 1 May 2016 until 31 August 2016) to be drawn Tuesday 6 September 2016 at 10am ACST

Draw 5: (for entries from 1 May 2016 until 14 October 2016) to be drawn Tuesday 25 October 2016 at 10am ACST

 

Draws 1-4: for each draw date, one (1) Minor Prize winner will be randomly selected through approved electronic draw system, DrawMyComp (NSW Approval Number 525 and SA Approval Number 959) in the presence of a panel of officials including an independent scrutineer.  All entries are then rolled over to subsequent draw date(s) and all Minor Prize Winners are eligible for the Major Prize Draw.

 

Draw 5: for this draw date, (1) Major Prize Winner will be randomly selected through approved electronic draw system, DrawMyComp (NSW Approval Number 525 and SA Approval Number 959) in the presence of a panel of officials including an independent scrutineer.  

 

WINNER ANNOUNCEMENT: All Prize Winners will be notified by phone and confirmed in writing within 5 business days of each draw. Winners will be announced on the Engel Facebook Page (www.Facebook.com/EngelAustralia) and will remain on the Engel Australia website (www.engelaustralia.com.au) for 28 days. Winner Announcements will take place on:

Friday 10 June 2016 (draw 1), Friday 8 July 2016 (draw 2), Friday 12 August 2016 (draw 3), Friday 9 September 2016 (draw 4), Friday 28 October 2016 (draw 5).

 

GENERAL PRIZE CONDITIONS RELATING TO ALL PRIZES: Prizes cannot be exchanged or redeemed for cash. If for any reason, the Prize Winner cannot accept the Prize within ninety (90) days of notification, the Prize will be forfeited and a redraw will take place.

 

The Prize must be taken as offered and cannot be varied. Any element of the Prize not taken by the Winner for any reason, will be forfeited by the Winner and cash will not be awarded in lieu of that element of the Prize. Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value.

 

Prizes are subject to availability. If any of the Prize options are unavailable, for whatever reason, the Promoter reserves the right to substitute any of the Prizes for a Prize of equal or greater value, subject to state regulation and subsequent approval.

 

Entrants can only enter in their own name and use their own contact details. The Promoter reserves the right to request the winner provide proof of identity, proof of residency, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to validate and check the authenticity of any Prize claim or entry before awarding the Prize.

 

The Prize winner is advised that Tax implications may arise from their prize winning and they should seek independent financial advice prior to the acceptance of the prize.

 

ADDITIONAL PRIZE CONDITIONS RELATING TO THE MAJOR PRIZE:

The Major Prize includes:

Vehicle: the first twelve (12) months vehicle registration in the winner's State or Territory of residence; the first twelve (12) months compulsory third party insurance and other on road costs including, stamp duty, dealership charges and statutory charges, as required by the State or Territory of the winner's residence.

 

Boat: the first twelve (12) months boat registration and (12) months trailer registration in the winner's State or Territory of residence.  

 

Camper: the first twelve (12) months camper registration in the winner's State or Territory of residence.

 

All ancillary costs or accessories not expressly provided are the responsibility of the winner. The Major Prize excludes comprehensive insurance, operational costs, fuel, personal costs and any other ancillary or incidental costs related to the Major Prize or anything else not specifically mentioned in these Terms and Conditions, which remain the responsibility of the winner.

 

If the winner is, through any legal incapacity or otherwise, unable to register the vehicle in his or her name then the winner may assign the vehicle prize to another person with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and an assignee.

 

The vehicle/boat/camper will be made available for the winner to collect from the Toyota/Stabicraft/Jayco dealerships nearest to the winner's place of residence as stated in their entry details. All costs associated with travel to and from the dealerships is at the winner's own costs. The collection date of the vehicle/boat/camper is subject to availability of the prizes, but is anticipated to be within 8 weeks of verification of the winning entry.

 

Subject to these terms and conditions, the Promoter accepts no responsibility for any mechanical, body or paint repairs or maintenance of any kind relating to the Major Prize after the date and time of prize collection by the winner.

 

REDRAW PROCEDURE: The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these competition conditions, forfeiting or not claiming a prize. If the prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a further draw(s) at the same time and place as the original draw on Tuesday 27 February 2017 subject to state regulations and the winners will be notified by phone and in writing.  All Redraw Prize Winners will be notified by phone and confirmed in writing within 5 business days of the draw. Redraw Winners will be announced on the Engel Facebook Page (www.Facebook.com/EngelAustralia) on Friday, 3 March 2017 and will remain on the Engel Australia website (www.engelaustralia.com.au) for 28 days.

 

PUBLICITY: It is a condition of entry into the Promotion that the Winner consents to the publication of their name and city of origin in any advertisements or articles relating to the Promotion or the Prize and in any announcements regarding prize winners on the Engel Facebook page, Youtube, other forms of social media and on the Engel website and participates in any media releases, which may include photographs or videos of the Winner by the Promoter.

No payment will be given for any publicity achieved as a result of this Promotion.

 

RELEASE: To the fullest extent permissible by law, each entrant including the Prize Winner and any person partaking in any component of the Prize, releases and indemnifies the Promoter from any claim, loss, damage, injury, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred in connection with the Prize or Promotion or participation in the Prize or Promotion. The Promoter's responsibility for the provision of prizes is limited to the Prize(s) described in these Terms and Conditions, the Promoter accepts no further liability or commitment beyond those stated and is not liable for any failure of the Promoter's agents or contactors to supply the Prize(s) as stated.

This condition does not affect, and is not intended to affect, any rights a consumer may have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servants or agents for breach of any such rights are limited to re-supply of the prize.

 

DISPUTES: In the event of a dispute, the decision of the Promoter is final and binding.

ALTERATION: Subject to any regulatory requirements, the Promoter reserves the right to alter these Terms and Conditions to address any misinterpretation, misinformation or misunderstanding in the application of these Terms and Conditions, as is permitted by law. The Promoter's decision will be final.

ACCEPTANCE: Participation in the Promotion constitutes acceptance of these Terms and Conditions.

DISQUALIFICATION: Any failure to comply with these Terms and Conditions may result in immediate disqualification of an entrant or the Prize Winner. Disqualification will be at the Promoter's sole discretion.

CANCELLATION: The Promoter reserves the right to cancel the Promotion at any time prior to the commencement of the Promotion Period for any reason, including, without limitation, if the Promoter determines that the Competition cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond the Promoter's control corrupt the administration, security, fairness, integrity or proper play of the competition. In the event any tampering or unauthorised intervention may have occurred, The Promoter reserves the right to void suspect entries at issue. Subject to relevant state regulation, any attempt to damage the content or operation of this competition is unlawful and subject to possible legal action by the Promoter.
